Terms of Service
Last updated: 2026-08-10. Effective on the date you first use the Site.
1. Who we are
CapeBretonFirst.com (“the Site,” “we,” “us”) is operated by Chants' IT Solutions, a sole-proprietor business based in Cape Breton, Nova Scotia, Canada. Hotel bookings on the Site are facilitated through Expedia Group Inc. (“Expedia”); payment processing is handled by Moneris Solutions Corporation (“Moneris”).
2. Accepting these Terms
By creating an account, submitting a listing, booking a hotel, or otherwise using the Site, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Site.
3. Eligibility
You must be at least the age of majority in your jurisdiction (19 in Nova Scotia) to make a booking or enter into a payment transaction on the Site.
4. Accounts
You're responsible for keeping your account credentials secure. We strongly recommend enabling multi-factor authentication. Notify us at [email protected] immediately if you suspect unauthorized access.
We may suspend or terminate accounts that engage in fraud, abuse, scraping, automated booking, or violation of these Terms.
5. Listings (businesses, places, golf, events, blog)
We aggregate factual public information about Cape Breton businesses, places, golf courses, events, and articles. Listings on the Site do not constitute an endorsement; we do our best to keep details accurate but make no warranty as to completeness, currency, or availability. If you spot an error, please tell us.
Owners may claim their listing through our claim flow. Claimed listings are subject to additional terms communicated to the owner at the time of claim.
5b. Visitor photos and other user-submitted content
When you submit a photo, review, forum post, or any other content to the Site (collectively, “User Content”), the following applies. This section is called out for visitor photos in particular because the upload form links here directly.
Ownership and rights you must have. You may only submit User Content that you own the copyright to (typically that means you personally took the photo, wrote the words, or produced the material) or that you have explicit written permission from the copyright holder to share publicly. Do not submit content pulled from Google Images, other tourism sites, Instagram accounts you don't control, or anything you found online without permission. Doing so may expose you to a copyright claim; you agree to indemnify Cape Breton First for any such claim arising from content you submitted.
People in photos. If your photo contains identifiable people (their face is recognisable), you must reasonably believe they consent to appearing on a public tourism website. Do not submit photos of children whose parent or guardian has not consented. If anyone in the photo later asks for it to come down, we will remove it.
Licence you grant us. By submitting User Content, you grant Cape Breton First a worldwide, non-exclusive, royalty-free licence to store, resize, re-encode, display, and attribute the content on the Site, in emails, in social-media posts about the listing, and in printed collateral produced for the same purpose. You keep the copyright; this licence just lets us use the content in the ways you obviously intended when you uploaded it. The licence continues for as long as the content is on the Site.
Moderation and removal. Uploads land in a pending queue and are reviewed by an admin before appearing publicly. We may reject, edit (e.g. crop for aspect ratio), or later remove any User Content at our discretion — including for quality, relevance, safety, or copyright reasons. You can also request removal of your own content any time by emailing [email protected] — we will action it within 5 business days.
Consent record. When you upload a visitor photo we record the timestamp of your consent and the version of these Terms in effect at the time. That record is used only for handling copyright inquiries.
Reporting infringement. If you believe content on the Site infringes your copyright, email [email protected] with the URL, a description of the work, and a statement that you are the rights holder. We take these seriously and act promptly.
6. Hotel bookings
Hotel rates, availability, and rooms are sourced from Expedia's Rapid API. When you book on the Site, your reservation is made directly with Expedia and the hotel; Cape Breton First is acting as a booking facilitator under Expedia's Rapid Affiliate Agreement. The contract for the stay is between you and the hotel, with Expedia handling fulfilment.
Cancellation policy for each rate is shown to you at the time of booking and on your confirmation. Refundable rates can be cancelled before the deadline shown on your booking; non-refundable rates cannot be cancelled for refund. Refund processing typically takes 5–10 business days to appear on your statement.
Total price shown on the booking page includes our service markup and Nova Scotia HST (14%). The price you see at checkout is the price you pay; we don't add fees after the fact. If a price discrepancy is detected during the pre-booking check, you'll be notified before being charged.
Hotel responsibility. The hotel is the operator and is responsible for the room, its condition, amenities, and the guest experience. Cape Breton First is not liable for the quality of the stay, hotel staff conduct, lost or stolen items, or any other on-property matter. Disputes about the room itself should be raised with the hotel; payment disputes can be raised with us at [email protected].
7. Payments
Payments are processed by Moneris. We do not store your full card number; only a masked PAN (last four digits) is retained for receipt purposes. By entering a card on the Site you authorize us to charge it for the total shown.
If we're unable to confirm your booking with the hotel after charging your card, the charge is automatically voided. If a void fails for any reason, we will issue a refund within 3 business days and notify you by email.
8. AI trip planner
The AI itinerary builder uses Anthropic's Claude model to suggest stops based on real businesses and places listed on the Site. The output is a starting point, not a guarantee — verify hours, prices, and availability before relying on a suggestion. We reserve the right to limit usage to prevent abuse.
9. Acceptable use
You agree not to:
- Use the Site to commit fraud or test stolen payment cards
- Scrape, mirror, or republish listings without our written permission
- Submit false reviews, fake claims, or impersonate another business
- Disrupt service through abusive request volume or automated probing
- Use the AI builder for purposes other than planning a Cape Breton trip
10. Intellectual property
Site design, code, original photography, and editorial content are the property of Chants' IT Solutions. Listings include factual data and operator-supplied content used under fair-dealing for the purpose of a directory.
11. Disclaimers
The Site is provided “as is.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, Cape Breton First's total aggregate liability arising out of or relating to these Terms or your use of the Site is limited to the greater of (a) the amount you paid to us in the 12 months prior to the event giving rise to the claim, or (b) CAD $100. We are not liable for indirect, incidental, consequential, or punitive damages.
13. Governing law and disputes
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any dispute arising out of or relating to these Terms or your use of the Site is subject to the exclusive jurisdiction of the courts of Nova Scotia.
14. Changes
We may update these Terms from time to time. The “Last updated” date at the top will reflect the change. Material changes will be communicated by email if you have an account. Your continued use of the Site after a change means you accept the updated Terms.
